Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your use of the ToothPal and BabyBloomy mobile apps and related websites (together, the "Apps"), provided by MYDY VENTURES LTD ("mydy Ventures", "we", "us"). By downloading or using an App you agree to these Terms. If you do not agree, do not use the Apps.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use the Apps. The Apps are intended for adults; BabyBloomy is intended for parents and caregivers.

3. Not medical advice

The Apps provide general wellness and informational content only. ToothPal scores and insights are not a medical or dental diagnosis. BabyBloomy guidance is not medical advice. Neither App replaces a qualified healthcare professional. Always seek the advice of a doctor, dentist or other qualified provider with any health question, and in an emergency contact local emergency services.

4. Your account

You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account. Tell us promptly at support@mydyventures.com if you suspect unauthorised use.

5. Subscriptions and purchases

• Some features require a paid subscription or in-app purchase. Prices and features are shown in the App before purchase.
• Purchases are processed by Apple (App Store) or Google (Google Play) under their terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions in your App Store or Google Play account settings. Deleting the App does not cancel a subscription.
• Refunds are handled by Apple or Google according to their policies, and as required by applicable consumer-protection law.
• Free trials, where offered, convert to a paid subscription at the end of the trial unless cancelled.

6. Your content

You keep ownership of the photos, logs and other content you add to the Apps ("Your Content"). You grant us a limited licence to store, process and display Your Content solely to provide and improve the Apps for you, as described in our Privacy Policy. You confirm you have the right to upload Your Content, including content about your child.

7. Acceptable use

You agree not to: use the Apps unlawfully or for others' private data without permission; upload content that is illegal, harmful or infringing; reverse-engineer, copy or resell the Apps except as permitted by law; interfere with the Apps' security or operation; or use automated means to access the Apps.

8. Intellectual property

The Apps, including their software, design, text, graphics and trademarks (including "mydy Ventures", "ToothPal" and "BabyBloomy"), are owned by or licensed to mydy Ventures. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Apps on devices you own or control, subject to these Terms and the applicable app-store rules.

9. Availability and changes

We may update, change or discontinue features of the Apps at any time. We aim to keep the Apps available but do not guarantee uninterrupted or error-free operation.

10. Disclaimers

To the maximum extent permitted by law, the Apps are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of results, or non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, mydy Ventures will not be liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Apps. Our total liability for any claim relating to the Apps is limited to the amount you paid us for the App in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Termination

You may stop using the Apps and delete your account at any time. We may suspend or terminate access if you materially breach these Terms. Sections that by their nature should survive termination will survive.

13. Apple and Google

These Terms are between you and mydy Ventures only, not Apple or Google. Apple and Google are not responsible for the Apps or their content, have no obligation to provide maintenance or support, and are not responsible for any claims relating to the Apps. Apple and its subsidiaries are third-party beneficiaries of these Terms for Apps downloaded from the App Store and may enforce them against you. Your use must also comply with the App Store and Google Play terms of service.

14. Governing law and jurisdiction

These Terms are governed by the laws of the country in which MYDY VENTURES LTD is incorporated, without regard to conflict-of-laws principles. The competent courts of that country will have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and, for material changes, notify you in the App. Continued use after changes take effect means you accept the updated Terms.
